Can a client sue a make-up artist for getting an allergic reaction to the makeup?

If a freelance make-up artist w/no license did someones makeup... and that client had a bad reaction... could they sue them?





Also, Could the makeup artist have the client sign papers before they do their make up to avoid this?





Because most of all makeup artists that are freelance don't have licenses.Can a client sue a make-up artist for getting an allergic reaction to the makeup?
You can sue anyone for anything or even nothing. However, to win, you would have to show the makeup artist was negligent. You would also have to show you had actual damages.





A make-up artist can have clients sign a release. If it were properly worded (have a lawyer do it - it's worth the money), it would hold up in court under most circumstances.Can a client sue a make-up artist for getting an allergic reaction to the makeup?
freelance make-up artist are not supposed to ever touch your face they are only supposed to bring you throw the steps.If you apply the make up yourself than you did it and no you could not sue.You MUST have a state license to legally apply make up to someone.Only in matters of maybe being a prides maid or playing with it like teenage girls do would make it ok.But anyone who calls themselves a freelance make-up artist must have a license to do this and inmost states some kind of insurance.
I'm no lawyer, so keep that in mind, but I think that the person suing would have to show that the make-up artist not only was negligent but also had malicious intent, something that would be very hard to prove. The laws also might vary state to state. What state did this occur in?





I just think about all those Avon and MaryKay reps out there who go around doing make-overs. There's no contract, as no one was forced to put on the make-up.
The answer would depend on what state you live in. I suppose, depending on the severity of the reaction, they could be sued for gross negligence.
Only if you knew or could have reasonably known that she'd be allergic.
